Dear respected Shaykh, assalamu alaikum wa rahmatullahi wa barakatuh. Does fasting during the days of Tashreeq suffice in making up for missed fasts in Ramadan?

Praise be to Allah, and may Allah’s peace and blessings be upon the Messenger of Allah, his family and his companions.   Wa alaikum assalam wa rahmatullahi wa barakatuh.   As to what follows:   In response to your question, we say:   That type of fast is valid and accepted, and in future do not fast during the days of Tashreeq with an intention to make up for missed days in Ramadan.  However, what has been done regarding this issue in the past is sufficient and acceptable. The proof for this is what has been transmitted in an authentic narration that the Prophet (peace be upon him) did not give anyone a concession to fast during the days of Tashreeq save for a person who cannot find a sacrificial animal in Hajj, as was mentioned by ‘Aisha, and ibn  ‘Umar (may Allah be pleased with them) [al-Bukhari (1997)]   The days of Tashreeq – which are the eleventh, twelfth and thirteenth of Thul Hijjah- should not be fasted except by a person who cannot afford a sacrificial animal, and this is the animal that is slaughtered in the tamattu’ or qiran hajj. As for a person who has to make up for missed days, or wants to fast optionally or in fulfillment of a vow; he should not fast during these days according to the preponderant opinion of the scholars. However, if a person has already done that (because of ignorance), his fasting will suffice Inshaa Allah.
