I have been married for about 16 years and then I have married another woman with a high status whom I love. However, the second wife cannot stand the idea that I am going to the house of my first wife; hence, and out of concern for her feelings, I completely stopped visiting my first wife for more than four months. Recently, I have decided to divorce my first wife though she agreed to live with me according to the new situation as she wants to remain my wife. The question is am I sinful for not having intimate relations with my first wife during the four months? Please note that I divorced her two times before and I do not dislike her but it happens that I prefer the second one who I do not wish to loose. Please guide me to what I need to do because the first wife has hope that I will return to her and does not mind that I married another woman. تزوج بثانية ورفض المبيت عند الأولى

Answer

All praise is due to Allah alone, and may the Salah and Salam of Allah be upon our Prophet Muhammad, his family and his companions. To answer your question, we say while seeking all the success from Allah:   If your first wife gives up her right to intercourse and it is not feared that she will be corrupted (fall in sins) because of that, then she can do it. However, I advise you to fear Allah and fulfill her sexual needs because women have sexual needs just like men. Further to the point, it is impermissible for you to neglect the rights of your first wife just to please the second wife. It was narrated that Abu Hurairah (may Allah be pleased with him) reported that the Prophet (may the Salah and Salam of Allah be upon him) said: “It is not permissible for a woman to demand her sister’s divorce so that she may take her place and get married; she cannot have more than what is decreed for her.” Reported by al-Bukhari (5152)
