Dear respected Shaykh, assalamu alaikum wa rahmatullahi wa barakatuh. Is it permissible to take interest money and disburse it to the poor, or we should leave it to the bank?

Praise be to Allah, and may Allah’s peace and blessings be upon the Messenger of Allah, his family and his companions.

Wa alaikum assalam wa rahmatullahi wa barakatuh.

To proceed:

In response to your question, we say:
It is compulsory to avoid dealing with interest based banks as much as possible. If out of necessity, a person has to deposit his money with these banks and in return he is given interest for depositing; the scholars are of two opinions in this regard:
First: Leaving it is obligatory and taking it is not permissible based on Allah’s saying in the verse that talks about interest: “You shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums)”. [al-Baqarah :279]. Therefore it is neither permissible to take the interest money nor accept it.
Second: Taking this interest is permissible, and it is obligatory for the one who takes it to get rid of it by disbursing it to interests (benefit) of Muslims and other types of beneficial expenditure. This view is based on that there is no oppression in taking this interest, because the bank gives it out with full satisfaction on one hand and on the other hand these funds would have been deposited into the account of the beneficiary and entered into his ownership by registration of the account. Therefore leaving it in the account does not remove it from his ownership.
This view is closer to the right opinion from what is apparent. Thus it is obligatory for the account holder to first agree with the bank on making interest free deposits, if the bank does not enable him to do that and he is forced by necessity to deposit then it is obligatory to get rid of this interest money.
